Beta / Early Access Agreement

This agreement is between Jake Bauman, a sole proprietor doing business as FrugalAI ("FrugalAI"), and the participant accepting it ("you"), and governs access to FrugalAI beta, preview, or early-access services and features ("Beta Services"). The FrugalAI Terms of Service, Privacy Policy, DPA, and Acceptable Use Policy apply to Beta Services except as modified below; this agreement controls where they conflict.

1. Access

FrugalAI may grant, limit, suspend, or end your Beta Services access at any time, for any reason. You may stop at any time. Beta access is free unless we agree otherwise in writing.

2. As-is

BETA SERVICES ARE PROVIDED AS-IS AND AS-AVAILABLE, WITHOUT WARRANTIES OF ANY KIND, WITHOUT ANY SERVICE LEVEL COMMITMENT, WITHOUT SUPPORT COMMITMENTS, AND WITHOUT THE LIMITED WARRANTY OR INDEMNITIES IN THE TERMS OF SERVICE. Beta Services may be unstable, may change or vanish without notice, and may never become generally available.

3. Production use

Beta Services are not intended for production workloads. If you route production traffic anyway, you do so at your own risk and should keep a direct-to-provider fallback you can switch to at any time.

4. Data

The Privacy Policy and DPA apply to personal data in your Beta Services content: beta is not a privacy free-for-all. However, beta data is not durable. FrugalAI may reset, migrate, or delete Beta Services data with 7 days notice (or without notice where required for security), and beta usage records may not carry into general availability.

5. Feedback

You grant FrugalAI a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and commercialize feedback, suggestions, and test results you provide, without attribution or compensation. Feedback is voluntary; do not include confidential information of third parties.

6. Confidentiality

Non-public features, roadmaps, and performance information about Beta Services are FrugalAI's confidential information. Do not disclose them publicly until they are generally available or we agree in writing.

7. Liability

FRUGALAI'S TOTAL AGGREGATE LIABILITY ARISING FROM BETA SERVICES IS CAPPED AT US $100. The exclusions of indirect damages in the Terms of Service apply.

8. General availability

Continued use of a feature after it graduates from beta is governed by the Terms of Service and then-current pricing. We will identify when a Beta Service graduates, and any fees, before charging you.

9. Term

Either party may end this agreement at any time by notice (email suffices). Sections 4 through 7 survive.
